Rogers man accused of driving while intoxicated, causing fatal wreck

BENTONVILLE — A Rogers man is accused of causing a fatal wreck Saturday while driving while intoxicated.

Asghar Martinez, 31, was being held Thursday in the Benton County Jail with a $50,000 bond set. He was arrested in connection with negligent homicide, a Class B felony.

He was also arrested in connection with second-offense driving while intoxicated, reckless driving and refusal to submit to an intoxication test.

Jane Everts was injured in the wreck and died Saturday at a hospital in Springfield, Mo.

Cpl. Aaron Faust, a detective with the Bentonville Police Department, responded at 10:19 p.m. June 4 to an injury accident in front of the Town Home Suites on Southeast 14th Street, according to a probable cause affidavit.

A black truck with front-end damage was still in the outside westbound lane of Southeast 14th St., according to the affidavit.

Martinez was standing beside the truck and told the detective that he was on his phone when the other driver hit him, according to court documents. Martinez said he was heading west and was driving 40 to 43 miles per hour, the affidavit states.

Faust observed that Martinez had bloodshot watery eyes, slurred speech and he was swaying, according to the affidavit. Martinez said he had drank two beers, then later told the detective he drank five beers and it had been 30 minutes since he had drank, the affidavit states.

Martinez also said he had taken Nyquil for a cold, the affidavit states.

Martinez took a field sobriety test at the scene and Faust observed intoxication clues during the testing, according to court documents.

According to the affidavit, the accident investigation showed Martinez crossed from the westbound lanes of the street and entered the eastbound lanes of oncoming traffic and collided with two vehicles, according to court documents.

Faust took Martinez to a hospital to obtain a blood sample for testing, according to court documents. Martinez had originally agreed to the blood draw, but refused when the phlebotomist began the process, the affidavit states.

Police attempted to reach a judge to obtain a warrant in order to get a sample of Martinez’s blood, but the attempts failed, according to court documents.

Prosecutors have not yet filed a formal charge against Martinez. His arraignment is scheduled for 8 a.m. July 11 in Circuit Judge Brad Karren’s court.
