September trial set for murder suspect

FORT SMITH -- A Sebastian County man faces trial in September in the fatal shooting of another man last winter.

Denver Pennington, 30, of Hackett was scheduled Wednesday to go to trial Sept. 6 in Sebastian County Circuit Court, according to the court administrator's office.

He has pleaded innocent to charges of first-degree murder and being a felon in possession of a firearm in the Jan. 26 shooting death of Arthur McIntyre, 33, outside McIntyre's home at 3001 Alabama Ave. in Fort Smith.

Pennington has been held in the Sebastian County jail in lieu of $500,000 bond since his arrest earlier this year.

According to police records, Pennington said he shot McIntyre because McIntyre was coming at him with a knife. Pennington's girlfriend witnessed the shooting, according to police, and told officers that McIntyre was not armed when he was shot.

Police officers arrested Pennington after receiving a phone call from Pennington's grandmother in Texas telling them that Pennington had called her asking for money and told her he had shot someone, according to reports. When he asked her what he should do, she advised him to surrender to police, reports say.
