Move Keeps Auction Houses Out Of Industrial Zones

SPRINGDALE — A second effort at allowing an auction house in an industrial zone met the same negative fate as the first.

The Springdale Planning Commission voted Tuesday against recommending adding an auction house as a conditional use in a light industrial zone.

The request still goes to the City Council but without the commission’s recommendation.

The change was requested so Don Guthrie could operate an auction house at 605 Bain Ave. Guthrie leased half of the building on Bain before he realized he couldn’t operate his business without the change.

The building is in a light industry area developed by the Springdale Public Facilities Board, under its original name of the Springdale Industrial Commission. Fadil Bayyari, the property owner, told the council he thought an auction house was allowed in industrial zoning. Bayyari is the former chairman of the commission.

Jim Crouch, board chairman, said he opposed the ordinance. A commercial business didn’t fit in with the area, he said.

The first time the proposal came before the Planning Commission, it included light and heavy industrial zoning. The commission, that time, voted 6-2 to recommend the council not approve the ordinance.

When that proposal came to the council, it voted 3-2 to allow auction houses in industrial zoning with a conditional use permit, but state law requires a majority vote of the council members, not a majority of the members present. With eight seats on the council, five votes are needed.

Guthrie’s application for such a permit also was voted down by the commission. The permit was dependant on the council approving the zoning change.

Guthrie can appeal his conditional use permit to the council.

The council also voted to cite the Marshallese New Beginnings Church, at 2250 S. Sunset Ave., as not in compliance with its conditional use permit. Neighbors who live in an apartment complex behind the church complained about loud music running late into the night. The Police Department provided a list of calls and complaints about the noise.

The church will be give 30 days to comply with the noise ordinance or have its conditional use pulled.
