Four charged in death of Fort Smith man

FORT SMITH -- Three men and a teen shot and killed a man last weekend, firing more than 30 rounds into the travel trailer because they believe the dead man disrespected their gang, police said in court documents filed Tuesday.

Jorge Andres Chirinos, 16, Bryan Porras, 19, Ryan Saige Oxford, 20, and Alberto Damien Chavez, 18, all of Fort Smith, each were charged in Sebastian County Circuit Court with first-degree murder and terroristic act in the shooting death Saturday of 18-year-old Justin Lopez.

All four were being held without bond and are scheduled to be arraigned in Circuit Court at 8:30 a.m. today, according to a news release from Prosecutor Daniel Shue.

Porras also was charged with two counts of being a felon in possession of a firearm, possessing a defaced firearm, simultaneous possession of drugs and firearms, possession of morphine and possession of drug paraphernalia. He also was charged as a habitual criminal, which will provide for increased sentences if he's convicted.

Mariah Kay Crocker, 18, of Fort Smith was charged along with Porras with the drug and firearms charges. She also was being held without bond Tuesday and is scheduled to be arraigned today.

A probable cause affidavit said Porras drove a vehicle with the four males who had guns and a list of people they believed disrespected their gang, Slanga 96.

They drove to 2315 North Ninth St. about 10:30 p.m. Saturday where they fired more than 30 rounds from at least two guns into a camping trailer parked behind the home.

Inside were Lopez and Trey Miller, 20. Miller, who survived the barrage uninjured, told police he and Lopez heard a noise outside the camper. When they opened the door, they saw several males outside. They retreated back into the camper as the shooting started.

Lopez was hit at least once by the gunfire while Miller hid in a bathroom at the back of the camper, according to police.

Arrests of the five were made throughout the day Sunday. Porras was arrested about 4:15 p.m. by SWAT team members during a traffic stop shortly after leaving his apartment at 220 May Ave.

Police searched the apartment where Crocker, identified as Porras' girlfriend, lived. Police found two guns along with drugs and drug paraphernalia throughout the apartment.

Probable cause affidavits on Chavez and Oxford said they admitted to being part of the group shooting at the camper trailer. The affidavit involving Chirinos said only he rode with the others to the shooting.

According to circuit court records, Chavez was charged in September 2014 with manslaughter and first-degree battery. The disposition of the charges was unavailable because the case was transferred to juvenile court in March 2015. Chavez was 16 at the time.

Porras was charged last year with six drug offenses: three counts of possession of drugs with intent to distribute and three counts of possession of drug paraphernalia. He pleaded guilty to all the charges in June and was given 10-year and five-year suspended sentences, according to the court records.
