In UA rape reports, 1 case open, 2nd closed

FAYETTEVILLE -- Prosecutors have declined to file any charges after a woman told police in April that she had been raped in 2013 at a University of Arkansas at Fayetteville residence hall.

Another case remains under review for possible charges after a police investigation began in March into a reported acquaintance rape at the Sigma Alpha Epsilon fraternity house, Washington County prosecutor Matt Durrett said in an email.

The 2013 now-closed case had "insufficient evidence to file anything at this time," Durrett wrote. He said the decision was made by his office about three weeks ago. The former UA student told university police that she had been raped at the Maple Hill West residence hall in November 2013. Police said in April that they knew the identity of the woman's possible attacker, an acquaintance of hers.

As a Class Y felony, rape in Arkansas has a statute of limitation of six years unless DNA evidence provides a profile of the crime's perpetrator.

In the case still under review, university police said in March that an 18-year-old UA student told authorities that she had been raped about two weeks earlier at a fraternity house during the early morning hours of Feb. 27. Police said they had identified a 20-year-old UA student not associated with the fraternity as the woman's possible attacker.

A police report from February released by UA details an interview with a woman who told police that she had seen two women crying early on Feb. 27 behind the fraternity house and that one said the other had been raped.
