Former band director faces rape charges involving Harrison teens

A Branson, Mo., man has been arrested on charges of statutory rape and sodomy while he was a band instructor last year at Harrison High School.

Kyle Lee Smith had sex with two of his female students, ages 14 and 16, while he was employed by the Harrison School District, according to an affidavit filed Jan. 7 in federal court in Fayetteville.

Both girls traveled to Branson "to engage in sex acts with Smith," according to the affidavit from Jeffrey Pryor, a special agent with Homeland Security Investigations.

Smith resigned from the Harrison job in September after he and school officials became aware of the investigation.

Smith was arrested last week in Branson. He waived formal arraignment and pleaded not guilty, according to Missouri court records.

Smith was being held Thursday in Taney County, Mo., jail with a cash or surety bond set at $100,000. He is scheduled to appear in court in Forsyth, Mo., on Monday.

Smith has been charged with four counts each of rape and sodomy.

The 16-year-old told police she and Smith had sex on two occasions last summer, both of which were at his home in Branson.

The 14-year-old told police she and Smith had sex on at least five occasions, two of which were at his home after Smith picked her up and drove her to Branson, according to the affidavit.

The 16-year-old saved Smith's telephone number in her cell phone under the name "Good Booty," according to the court document.

Both girls told police they exchanged nude digital photographs with Smith, according to the affidavit.

The Missouri court system lists Smith's birth year as 1987 but doesn't give a specific date.
