Accused shooter in motel standoff fit for trial, report shows

FAYETTEVILLE -- A man police say shot at an officer during a standoff at a motel doesn't suffer from a mental disease or defect but did likely experience a major depressive disorder, according to a mental examination at the Arkansas State Hospital.

Bryan Durbin, 42, homeless, was arrested Sept. 8 and is charged with attempted capital murder and terroristic threatening.

Durbin is charged with attempted capital murder because he shot at an officer, according to police.

A mental examination was requested by the defense to determine if Durbin is competent to stand trial. Durbin understands the legal proceedings against him and can assist in his defense, according to the report filed Monday.

Police went to Room 130 at Motel 6 at 2980 N. College Ave. where they heard a disturbance in the background, according to police records.

Durbin used a gun to threaten his girlfriend, Teresa Lynn Johnson, 45, according to police documents. He told police he wanted to die, was intoxicated and had no place to go.

Durbin released Johnson. Officer Daniel Plume was against a wall on the west side of the motel when Durbin aimed his weapon at him and fired one round, according to the report. Plume was not injured.

Durbin barricaded himself in the room and negotiated with police for the next four hours. He was arrested without incident after he appeared to fall asleep on a bed, according to dispatch records.

Durbin is being held at the Washington County Detention Center in lieu of $15,000 bond.
