Springdale auction house back in compliance

SPRINGDALE --A business owner has fixed his business's violation of conditional use permit.

Springdale's Planning Commission approved at Tuesday's meeting allowing the auction house at 103 and 105 Spring St. to continue with its permit. The motion also included all violation issues had been addressed.

Springdale Planning Commission approved Tuesday:

• A planned parking lot on East Meadow Avenue near the railroad tracks. The land is owned by Poultry Growers, which is owned by Tyson Foods.

• Rezonin 307 N. 48th St. from agricultural district to thoroughfare commercial district.

• Rezoning 4149 N. Thompson St. from general commercial district to thoroughfare commercial district.

• Rezoning 909 S. Thompson St. from general commercial district to thoroughfare commercial district.

• Rezoning 3448 Wagon Wheel Road from agricultural district to general commercial district.

Kenneth Harold Warner III has owned the property since March 2006, according to Washington County Assessor's Office online property records. Online property records state the business is Ken's Auction Gallery.

The community engagement division investigated after someone complained in February about parking, fire code violations and unsanitary and unsightly conditions, Missha Wagoner, division supervisor, has said. Between then and August, Wagoner has said the business violated the city code for unsanitary and unsightly conditions on private property, came into compliance, then violated the same code again. A citation was issued.

During the investigation, the city found the business violated its permit, Wagoner has said. The business was only supposed to operate on Friday and Saturday, but was operating some Thursdays.

Warner has said the business began to hold auctions Thursday and Friday nights instead of Friday and Saturday nights. This is because the business has grown and many people have other plans on Saturdays, he said. Warner also said at Tuesday's meeting he didn't want one of his auctions to conflict with other auctions held Saturday.

The business has the conditional use permit because it is zoned as a downtown district, Patsy Christie, city director of planning and community development, said. A business in this type of zone can have an auction house through a permit.

The Planning Commission approved a permit for the auction house in 2006, according to a city document. Seven commissioners voted yes, while none recused or voted no.

Warner was present at the meeting in 2006, according to the document. He said at the time he planned for the property to have an office and a gallery used for auctions. He also said the auctions would be Friday or Saturday nights.

Warner said he stopped holding auctions Thursday when he received a letter about the issues. He said he didn't know in 2006 that Friday and Saturday would be "locked in."

Warner said he plans to come back to the commission to request a revision to his permit. The revision would be for additional nights for auctions.

Wagoner said at Tuesday's meeting Warner had done a good job at cleaning up the areas where there were issues.
