Woman suing sheriff over medical care in jail

BENTONVILLE -- A Washington County woman is suing the Benton County sheriff's office over her medical treatment when she was in jail three years ago.

Ashley Ober filed the lawsuit last week against Sheriff Kelley Cradduck and his office. She is represented by Fayetteville attorney Josh Bailey.

Ober was ordered to serve 30 days in the Benton County jail on May 24, 2012. She didn't report any medical problems at the time, according to court documents. She later developed a mild toothache that became painful and swollen, according to the complaint.

Keshia Guyll, spokesman for the sheriff's office, said the incident happened under former Sheriff Keith Ferguson and his medical staff.

"We are diligently working toward gaining more knowledge of this claim and are hopeful for a resolution," Guyll said.

The lawsuit claims Ober submitted a medical request form May 25, 2012. The lawsuit claims no action was taken, she didn't see a dentist, doctor or nurse and she wasn't given any pain medication.

Ober requested medical attention and submitted a second medical request May 29, 2012. She reported her mouth was swollen and she couldn't eat, according to court documents.

Ober saw a doctor the next day. The doctor ordered an injection of the antibiotic Rocephin followed by penicillin tablets four times a day for seven days and Vicodin every four to six hours for five days as needed for pain.

The lawsuit claims jail staff didn't give Ober the medication as instructed. Her attorney filed a motion for her immediate release due to her not receiving necessary medical treatment. A circuit judge ordered Ober released June 5, 2012, according to court documents.

The lawsuit claims the lack of medical care exacerbated Ober's condition and caused her mental and emotional distress and increased her pain and suffering.

The case is assigned to Circuit Judge Xollie Duncan.
