Archivist asks judge to void arrest order

Attorneys for North Little Rock archivist John Rogers on Thursday asked a Pulaski County judge to withdraw his arrest order for Rogers.

Circuit Judge Timothy Fox issued a bench warrant for Rogers on June 8 for not responding to an order to produce discovery requests in a lawsuit filed last year by First Arkansas Bank & Trust of Jacksonville.

The order states that Rogers, after his arrest, can be released on a bond of almost $1.5 million or 10 percent of the judgment he faces in the lawsuit, which is excessive, Blake Hendrix, an attorney for Rogers said in the filing.

"I'm interpreting this order for 'body attachment' to be a criminal contempt proceeding," Hendrix said in an interview. "It's like a criminal case. You're entitled to all the constitutional protections under the Arkansas and federal constitutions, none of which appear to be provided for."
