Mayor: City Attorney Lipscomb's settlement, resignation finalized

Rogers City Attorney Ben Lipscomb has received payment and finalized his settlement agreement with the city of Rogers, including his resignation, according to Mayor Greg Hines.

A federal lawsuit filed against the city of Rogers by Lipscomb was been dismissed, according to court documents.

United States Magistrate Judge Erin Setser signed the order Thursday morning. It states the dismissal follows approval by the Rogers City Council, on Tuesday, to pay Lipscomb $390,000 to resign and settle the lawsuit. The dismissal is subject to the terms of the settlement.

Lipscomb had disputed tax withholdings on the check Monday.

Lipscomb filed the suit in November claiming the city council violated his constitutional rights when it transferred most of his duties to a staff attorney who answers to the mayor. Three alderman signed affidavits saying Libscomb suggested the changes to his job duties.
