Prosecutors dismiss rape charge against Rogers man

Prosecutors dismissed a rape case against a Rogers man.

Jackie McCargo, 48, appeared in court March 30 and learned that prosecutors would be dismissing his case. Prosecutors never even filed a formal charge in the case.

McCargo was arrested in February in connection with rape, a Class Y felony.

Stuart Cearley, chief deputy prosecuting attorney, said after further review of the evidence, it became apparent that the prosecutor's office had no reasonable probability of prevailing at trial.

He was accused of raping a woman in his home.

McCargo, who is a Level 3 sex offender, previously pleaded guilty to sexual assault in the fourth degree and he was placed on state supervised probation.

McCargo admitted violating terms of his probation and Circuit Judge Robin Green sentenced him to 60 days in the Benton County Jail, but gave him credit for the time because he had already served 60 days in jail.
