Rogers Registered Sex Offender Arrested

BENTONVILLE -- A Level 3 sex offender was arrested after he submitted an officer testing application to the Rogers Police Department.

Michael Anthony Barley, 25, of Rogers was being held in the Benton County Jail on Friday. He was arrested Thursday in connection with registered offender living near a school, public park, youth center or daycare and failure to register as a sex offender.

Barley submitted a testing application Sept. 1. Criminal history checks are done on all applicants.

Detective Brian Hanna was told an Arkansas Crime Information Center check showed Barley was listed as a sex offender and he didn't have a valid address. Police also learned Barley worked at Fast Lane Entertainment in Rogers.

Barley is a Level 3 sex offender by default because he failed to report for assessments. The report states Barley failed to appear for assessments Feb. 8, 2007, and March 6, 2007, according to the probable cause affidavit.

Barley was convicted of a sex offense as a juvenile. The crime included him repeatedly having sexual contact with a 6-year-old girl, according to the affidavit.

Arkansas law doesn't permit a Level 3 sex offender to live within 2,000 feet of a school. Barley lived 498 feet from the Arkansas Arts Academy, according to the affidavit.

Keith Foster, a spokesman for the Rogers Police Department, said rules and restrictions are explained to registered sex offenders.

Barley was given paperwork detailing state requirements for sex offender registration and outlines the limitations on where a sex offender can live, according to the probable cause affidavit.

The department occasionally gets applicants who have warrants, but this was the first time for an applicant to be a registered sex offender, Foster said.

Barley's arraignment is scheduled for 8 a.m. Oct. 20 in Circuit Judge Robin Green's court.
