Rogers sex offender arrested after applying for police officer test

A Level 3 sex offender was arrested Thursday after submitting an officer testing application to the Rogers Police Department.

Michael Anthony Barley was being held Friday in the Benton County Jail. He was arrested Thursday in connection with registered offender living near school, public park, youth center or daycare and failure to register as a sex offender.

According to a probable cause affidavit, Barling submitted a testing application on Sept. 1 and criminal history checks are done on each applicant.

Det. Brian Hanna was told that a check with the Arkansas Crime Information Center showed the Barley was listed as a sex offender and did not have a valid address. Police also learned that Barley was working at Fast Lane Entertainment, according to court documents.

Hanna learned that Barley is a Level 3 sex offender by default and the report states that Barley failed to appear for an assessment appointments on Feb. 8, 2007 and March 6, 2007, according to the probable cause affidavit.

According to the affidavit, Barley was convicted of a sex offense as a juvenile and the crime included him repeatedly having sexual contact with a 6-year-old girl.

Arkansas law does not permit a Level 3 sex offender to live within 2,000 feet of a school. Police learned that Barley lived within 498 feet from the property of the Benton County School of the Arts' property, according to the affidavit.

Barley was being held Friday in the Benton County Jail with no bond set.

His arraignment is scheduled for 8 a.m. Oct. 20 in Circuit Judge Robin Green's court.
