Rogers Commissioners Approve Three-Building Plaza

ROGERS -- A three-building plaza stretching from the Pinnacle Country Club subdivision to the roundabout on Pauline Whitaker Parkway was approved Tuesday by planning commissioners.

The property was rezoned Aug. 6, 2013, from residential single family to residential office and highway commercial over the objections of residents in the subdivision.

The Planning Commission met Tuesday and approved:

• A conditional use permit for Rogers Yellow Cab to allow transportation services at 2800 N. Second St.

• A large-scale development plan for Parker Grand Slam, a six-stall outdoor batting cage facility at 1906 W. Town West Drive.

• A large-scale development for 3,000-square-foot expansion to the existing 6,000-square-foot Freedom Powersports building at 2741 W. Hudson Road.

• A large-scale development plan for Yiannios Dental, a 6,000-square-foot dental clinic in the Pinnacle Hills Office Park, 3728 S. Pinnacle Hills Parkway.

• The final plat for Cross Creek Phase 4, a 28-lot subdivision west of Mount Hebron Road and south of Garrett Road.

During the public hearing last year about 20 Country Club residents stated traffic was already bad on Pauline Whitaker Parkway and a commercial development would only add to the problem. Other residents said the rezoning would hurt property values and others expressed concern over the heights of building that could be built in highway commercial.

Country Club Plaza is scheduled to have a two-story office building next to the subdivision, which is zoned residential office and a three-story office building in highway commercial on Pinnacle Hill Parkway. There is a single-story building for a restaurant and retail space.

A building can't be taller than 35 feet in residential office zoning and 135 feet in highway commercial, according to a city ordinance. A two-story building is normally less that 35 feet and a three-story building is usually less than 135 feet, according to city officials.

The three-story building, 4204 Pinnacle Hills Parkway, will have 88,000 square feet of office space, the two-story building, 5102 W. Pauline Whitaker Parkway, is 16,249 square feet and the restaurant/retail building, 5100 W. Pauline Whitaker Parkway, will be 21,489 square feet, according to the large-scale development plan.

The plaza will have three entrances and exits -- one on Pauline Whitaker Parkway, a right only exit, and two on Pinnacle Hills Parkway, which will allow drivers to make left and right turns when exiting the plaza.

The remainder of the 9-acre site will be a 467-space parking lot for the three buildings.

Commissioners found E&J Auto, 702 N. Second St., in violation of the conditional use permit the company received in early July. The conditional use permit allowed eight cars to be on display at the business.

On more than one occasion city officials said they counted more cars on the lot than allowed as well as cars being stored on property not zoned for open display or car storage.

City officials sent a certified letter in late July expressing concern with the excessive number of vehicles on the lot. On Aug. 8, a building inspector reported 12 vehicles were parked facing the alley north of the auto sales building.

"There are 14 cars parked on property next to the business as of today," said Mark Myers, commissioner.

"My question is what are you going to do about it," Myers asked the owner, Mr. Garmendia.

Through an interpreter, Garmendia stated the cars on the other lot belonged to him, but he had no idea he needed a conditional use permit for the storage of cars.

Garmendia has 30 days to move the excess cars from his lot and the property adjacent to the car lot to remain in compliance with the conditional use permit, said Chris Griffin, deputy city attorney.

"If he doesn't have any additional violation during the 30 days the conditional use permit can remain in place," Griffin said.

"If you do that this all goes away," Myers said.
