Cain Negligent Homicide Case Reset

FAYETTEVILLE -- The trial of a Lincoln man charged with felony negligent homicide related to a car wreck that killed his passenger was delayed Monday in Washington County Circuit Court.

Danielle Bishop, 34, was a passenger in a 1994 Chevrolet pickup driven by Kevin Fair Cain, 40. The accident happened about 10:45 p.m. Aug. 27 just north of the Washington and Crawford county line on Arkansas 59.

Cain was northbound when he veered off the road into the ditch on the east side, over-corrected and traveled back across the road and hit an embankment on the west side of the highway head-on, according to a State Police report. The vehicle then caught fire.

Bishop was unable to get out of the vehicle and was badly burned. Attempts to resuscitate her at the scene were unsuccessful, according to the report.

An arrest report said Cain was slurring his speech and could hardly stand. A breath test indicated Cain hadn't been drinking but he later told police he had taken hydrocodone and Klonopin.

Cain is also charged with reckless driving and driving on a suspended license, both misdemeanors.

The case was delayed because the Arkansas State Crime Lab has not completed testing of evidence.

The case was reset to April 7 and 8. Cain is free on bond while awaiting trial.
