Rape Charge Against Farmington's Donovan Dropped

FAYETTEVILLE -- Rape charges against a 19-year-old Farmington man were dropped Tuesday.

Dimitri Donovan, 19, of 122 Lark Lane, was accused of raping a 13-year-old girl in June.

Fayetteville police said Donovan picked up three girls: two 17-year-olds, and one 13-year-old at a store in Farmington. Police said he took the girls back to his home and gave them alcohol.

Donovan had sex with one 17-year-old and the 13-year-old, according to the arrest report.

Donovan told police he thought the younger girl was 16, according to the report. Because Donovan is younger than 20, he had a defense under state law if he had a reasonable belief the girl was older than 13.

Kevin Metcalf, deputy prosecutor, said Donovan had reason to believe the girl was much older than 13.

The girl told police she wanted to have sex with Donovan, according to the report.

Donovan had a court date Tuesday.
