First Security Files Suit Against Rogers' Smiley

First Security Bank claims H. Dennis Smiley Jr. owes $233,306 on loans worth $240,000.

The bank on Monday filed a complaint in Benton County Circuit Court, which also names his wife, Cynthia Smiley; his father, Henry Dennis Smiley Sr.; HDS Holdings LLC; and The Henry Dennis Smiley Revocable Trust as defendants. First Security is the latest bank to file suit against Smiley.

First Security states in its filing Smiley Jr. used his home at 56 Champions Blvd. in Rogers as collateral on the loans he took out May 16, 2012, and Feb. 1, 2013.

The bank issued the first loan, worth $200,000, to Smiley Jr. and his wife. It issued the second loan for $40,000 to HDS Holdings.

First Security also states in the complaint Arvest Bank and Benefit Bank may also hold mortgage claims.

Smiley is the former president of Arvest Bank of Benton County. He resigned March 13.

Smiley Sr. is chairman of First State Bank of De Queen.

Kenneth Mourton, an attorney at Ball & Mourton in Fayetteville who represents Smiley Jr., didn't return a message left at his office by 5 p.m. Tuesday.

Simmons First National Bank filed a lawsuit in May claiming Smiley Jr. and Design for the Home, a company owned by Cynthia Smiley, owe $69,011 on three loans worth $146,282. Simmons also sued Smiley Sr. and HDS Holdings for $88,716.

Delta Trust was the first bank to file a complaint against Smiley Jr. On March 25, the bank claimed the Smileys and HDS Holdings missed the initial payment on a $245,126 loan they took out Feb. 20.

First Federal, First State Bank and Bank of Fayetteville have also filed complaints against Smiley Jr.
