$100,000 bond set for Siloam Springs man accused of rape

A woman said a Siloam Springs man raped her because the police had previously been called concerning him smoking marijuana, according to court documents filed Thursday.

Bryan Dwayne Weary, 42, was being held Friday in the Benton County Jail with a $100,000 bond set. Weary was arrested Tuesday in connection with rape, a Class Y felony, and aggravated assault, a Class D felony. He was also arrested on misdemeanor charges of domestic battering in the third degree, possession of a controlled substance (marijuana), and possession of drug paraphernalia.

Police responded to a 8:59 a.m. Tuesday call in reference to a rape report, according to a probable cause affidavit.

A 27-year-old woman told officers that Weary had raped her because he was angry that the police had been called the previous day about him smoking marijuana, the affidavit states.

According to the affidavit, the woman told police that Weary had called her a snitch and acted angry toward her. The woman said she told Weary that she did not call the police on him, the affidavit states.

The woman said Weary grabbed her by the throat and threw her against a counter top and she blacked out, the affidavit states. According to the affidavit, the woman said after she was conscious again that Weary raped her.

The woman said she was unable to call police because Weary kept watching her, according to the affidavit. She was able to call police when Weary left the apartment to go to work, the affidavit states.

Rogers District Judge Paul Bridges set Weary's bond at $100,000 during a bond hearing on Thursday.

Weary's arraignment is scheduled for 8 a.m. March 3 in Circuit Judge Robin Green's court.
