Man arrested in connection with Benton County disturbance

Authorities won't confirm if man was shot by deputy

A Rogers man was arrested Saturday in connection with several charges stemming from a family disturbance, according to a probable cause affidavit.

Devin Dean Weaver, 24, of 20329 Canary Road, in the Rocky Branch area, was arrested in connection with aggravated assault, aggravated assault on a family or household member, domestic battery in the first degree, terroristic threatening in the first degree, two counts of endangering the welfare of a minor in the first degree, three counts of false imprisonment in the first degree and felony with firearm enhancement, according to the affidavit released Sunday.

The 20329 Canary Road address is where Benton County Sheriff’s Office representatives said a deputy shot a man during a disturbance on Thursday. Keshia Guyll, spokeswoman for the Sheriff’s Office, said in a message Sunday no names of those involved in the shooting would be released until after an Arkansas State Police investigation.

The affidavit does not say Devin Weaver was wounded in the altercation with deputies, although it does say he was transported to Washington Regional Medical Center in Fayetteville. A news release from the Sheriff’s Office advising of the officer-involved shooting said the man who was wounded was taken to Washington Regional.

Deputies went to the Canary Road address at about 1:30 a.m. Thursday after Ashley Weaver called 911, according to the affidavit. When Sgt. Charles Wells arrived, he saw Ashley Weaver inside the house, “covered in blood.” The deputy helped her escape, but two children remained in the home with Weaver, who was armed.

Ashley Weaver said Devin Weaver had hit her with a shotgun, with his fist and stomped her headed with his booted foot, according to the affidavit.

A deputy was able to convince Devin Weaver to allow the children to leave the house, according to affidavit. However he remained inside, and deputies reported hearing shots from inside the house.

The Sheriff’s Office’s SWAT team was on the scene, according to the affidavit, and after Devin Weaver was told to put the gun down, deputies reported hearing a door slam and shots being fired. Weaver was then transportated to the hospital.

Devin Weaver was in the Benton County Jail and no bond had been set Monday. A $250,000 bond was requested. It was also requested Devin Weaver be ordered to have no contact with Ashley Weaver or the children.
