Prosecutor Quits On Day Of Arrest

Sebastian County Deputy Prosecuting Attorney Earl S. Garrett, 33, resigned Saturday, the same day he was arrested on a misdemeanor charge of public intoxication at the Electric Cowboy in Fort Smith.

A police report by Fort Smith police Cpl. Clyde Forrest said an intoxicated Garrett had been told to leave the bar and then tried to use his identification from the 12th Judicial District prosecuting attorney’s office to try to get back inside.

Forrest gave Garrett two sobriety tests before arresting him about 3:55 a.m. Saturday. “His speech was slurred, he was unsteady on his feet and he was not able or was unwilling to answer my questions,” Forrest said in his report.

Garrett listed a Bentonville address in the report.

In a statement issued Monday by Sebastian County Prosecuting Attorney Daniel Shue, the prosecutor said: “There are many things that a deputy prosecuting attorney cannot engage in, both on the job and off-duty, if he or she is to command the respect of law enforcement, their fellow employees and the general public. His former colleagues and I are shocked at this turn of events.”

Shue made no further comment.
