Why Do We Have An Epidemic Of Bad Behavior?

Arecent article in the Wall Street Journal discussed the growing problem of lawyers becoming more and more aggressive in their practice, examples being anger, hostility and shouting during the taking of the deposition of a witness and court proceedings. These abusive tactics have spread to email and telephone calls, often with opposing counsel. However, the badgering and humiliation of witnesses is somewhat of a two-edge sword. Even though this tactic may on occasion be eff ective in discrediting a witness’s testimony during a trial, jurors often sympathize with a witness who is being mistreated and this tactic backfi res. Judges are tiring of the turmoil and delay that occurs because of this misbehavior.
