Alcohol Ordinance Approved

— The City Council approved an ordinance regulating the sale of alcoholic beverages after tweaking it to better conform with state laws Tuesday night.

The ordinance allows selling alcohol from 7 a.m. to 10 p.m., prohibits drive-through windows and requires a conditional use permit if retailers are within 500 feet of a city park or trail.

The ordinance initially allowed sales from 6 a.m. to 10 p.m., but Alderman Bill Burckart pointed out state law doesn’t allow sales before 7 a.m. City attorney George Spence agreed the amendment would help avoid confusion. Council members unanimously approved an amendment reflecting the change.

Burckart pushed for two more amendments he said would put local business owners on more even footing with retailers in surrounding cities. He proposed sales be allowed until 11 p.m. and drive-through windows be allowed with a conditional use permit.

“I think we’re putting our business owners at an unfair advantage,” he said.

Police Chief Jon Simpson spoke against both of the amendments. He said the windows would make it easier for a drunken driver to buy alcohol and cited later hours as more likely to attract a “rougher crowd.”

“In my experience as a patrol officer, as the night goes on the opportunities for things that are less desirable are more frequent,” Simpson said.

Council members voted down both proposed amendments.
