Fayetteville Shooting Trial Delayed

— The trial for a man accused in connection with a summer shooting incident has been delayed.

Kacey Derell Jones, 35, is charged with attempted capital murder, first-degree battery and being a felon in possession of a firearm. He is considered a habitual offender.

Jones’ trial was reset from Monday to April 4 and 5 in Washington County Circuit Court. Jones’ attorney was ill and requested the delay.

Jones is accused of shooting Lee Charles Brown Jr., 36. Brown was found in the yard of a residence in southeast Fayetteville the night of May 24 with a gunshot wound in his back. He was treated at Washington Regional Medical Center and released.

The shooting occurred during a large disturbance about 8 p.m. at a duplex near Fairlane Street and Curtis Avenue.

Jones was arrested in Marianna.

Police say Jones was shot in the finger during an earlier shooting incident. Tyrone Anthony Welch, 29, was charged with unlawfully firing a gun from a moving car in connection with a July 24, 2011, drive-by shooting at 2332 S. Clover St.

Welch was acquitted in October by a Washington County Circuit Court jury. Welch faces a charge of intimidating a witness related to the case. Police said Welch and another man, Allen Stevens, 32, threatened two men at a convenience store at 15th Street and Curtis Avenue in June, telling them to “warn their family against testifying” at Welch’s trial.

Prosecutors said they were hampered at Welch’s trial by several witnesses who couldn’t be found to testify or who had changed their stories.

Melissa Gralewski was tried earlier this year as an accomplice in the Clover Street shooting. A jury acquitted Gralewski of all charges.

Police said Gralewski is the mother of Welch’s child. Days before the Clover Street shooting, Welch and Jones fought at Dickson Theater, reportedly because Jones was dating Gralewski.
