Bella Vista Man Sues Association

— A Bella Vista man filed a lawsuit against the Property Owners Association on Wednesday.

Jim Parsons, acting as his own attorney, filed the lawsuit in Benton County Circuit Court. The case was assigned to Circuit Judge John Scott.

The lawsuit concerns an association policy of suspending water service for nonpayment of property assessments.

Parsons’ lawsuit claims the Property Owners Association board enacted a policy March 17, 2011, that called for the suspension of water service for nonpayment of assessments.

The lawsuit claims the association threatened to shut off the water of a least two members.

Chastity Clark Fittro, association attorney, said she hadn’t seen the lawsuit and couldn’t comment on it.

According to Parsons’ complaint, he and the two other residents bought their homes prior to March 17, 2001. Parsons doesn’t believe the shutoff policy should apply to members who bought their homes prior to that date.

Parsons want a court to order the shutoff policy be removed from the association board’s policy. He also seeks a monetary award to cover his cost for bringing the lawsuit.
