Disturbance Citation To Be Set For Trial

— A trial date for USA Metal Recycling will be set in connection with a noise citation.

Bill Smith, of USA Metal, was cited following an explosion at the plant Jan. 7. Smith was scheduled to appear in Lowell District Court on Monday, according to a court official.

Johnna Ritchie, chief court clerk, said the disturbance citation was not called Monday because Smith had hired an attorney. It will take about a week before a trial date is set, Ritchie said.

A propane tank, part of a cube of crushed metal, exploded when it was put in a shedder machine last month, company officials said. The explosion knocked pictures off walls and rattled windows, according to residents in the Southfork subdivision near the recycling plant.

This is the second citation issued to recycling plant employees. The first citation was issued more than a year ago. Neighbors have filed many complaints with the city regarding noise coming from the recycling plant.
