A federal judge chastised the state Department of Human Services this week for trying to “side-step the requirements of state and federal law” when it comes to funding day-treatment services for developmentally delayed children. U.S. District Judge Bill Wilson Jr. said the department’s actions appear to have been motivated by “political considerations” and violate the rights of the children, their parents and the clinics that provide the services. He said the department thus may not move “the type of services” offered under the Child Health Management Services program out of the state Medicaid plan.
