BENTONVILLE — An Independence, Mo., man has been arrested in connection with the rape of a 13-year-old girl.
Cody Wayne Elliot-Smith, 20, is being held in the Benton County Jail in connection with rape, a Class Y felony.
According to court documents, the girl, now 16, was being treated at a Fayetteville mental health facility when she disclosed being raped.
The girl claimed her attacker was Elliot-Smith, according to the probable cause affidavit.
According to court documents, the girl reported she was at home with Elliot-Smith and another girl when Elliot-Smith raped her. The girl said she told Elliot-Smith to stop and attempted to push him away, but he would not stop.
Elliot-Smith was questioned by Mike Lira, an investigator with the Benton County Sheriff's Office. Elliot-Smith recalled being intoxicated and couldn’t remember the night of the incident, according to the affidavit.
Prosecutors haven’t filed formal charges against Elliot-Smith, who is being held on a $100,000 bond at the Benton County Jail.
