Rezoning On Tap For Thursday

The City Council meets in regular session on the first and third Tuesday of each month. When a meeting conflicts with a holiday or general election, the meeting is to be moved to the following Thursday.

The council is set to consider a proposed rezoning on 21 acres in northeast Fayetteville. The undeveloped land is south and east of the Brookbury and Candlewood subdivisions.

Developers Darin Riggins, Kevin Riggins and Jim Lindsey have guaranteed in writing they would build no more than 37 houses on the land. All of the houses would be 3,500 square feet or larger.

Hugh Jarratt, an attorney representing Lindsey, said during an Oct. 16 City Council meeting developers would be willing to guarantee no more than 21 homes are built. As of Friday, the city’s Development Services Department hadn’t received that guarantee in writing.

Surrounding homeowners have criticized the project because they say it will add traffic and remove green space in their neighborhood.

Also on Thursday, the council will consider a request to delay permit requirements for a planned 122-unit apartment complex at West Cleveland Street and North Hall Avenue.

Seth Mims with Springdale-based Specialized Real Estate Group asked the City Council to push back his company’s deadline for obtaining construction permits by one year.

Mims, in an Oct. 17 letter to Jeremy Pate, Development Services director, said a lawsuit pending in Washington County Circuit Court could easily delay the development by 12 to 18 months. Nearby residents claimed in the lawsuit City Council members acted in an “arbitrary and capricious” manner when they approved Specialized Real Estate’s zoning and development application June 20.

University of Arkansas officials want to purchase or condemn a portion of the property where a 60-unit apartment complex and rental home are located.

The property is owned by Fadil Bayyari, a Springdale developer.
