Greenway Attorney To Contest Statements

— The attorney representing the man charged with murder in connection with his former girlfriend's disappearance plans to challenge the admissibility of statements his client gave police.

Blair Brady, who represents Randall Greenway, informed the court Monday of his intentions to file the motion.

"It will be more legal based than fact-based," Brady told Circuit Judge David Clinger. Brady did not elaborate in court.

Greenway, 38, is charged with capital murder in connection with the 2007 disappearance of Alicia Minton. He previously pleaded not guilty.

Brady said after the hearing the motion will be an attempt to suppress any statements Greenway gave to police.

Clinger gave Brady until Aug. 31 to file the motion. Prosecutors will have 30 days to respond. Brady said he may also file other motions in the case. Clinger scheduled a hearing on the motions for 1:30 p.m. Oct. 27.

Brady told the court Monday prosecutors have not yet decided whether they will seek the death penalty.

Benton County Prosecuting Attorney Van Stone said after the hearing he is still considering that option.

Minton, then 29 and living in Bentonville, was last seen at Enterprise Rent-A-Car on West Walnut Street in Rogers. She was a former girlfriend of Greenway's.

Greenway confessed he killed Minton to his then-girlfriend and at least six inmates, according to an affidavit.

The affidavit says that on June 10, 2007, Greenway's then-girlfriend told police Greenway confessed to her that he killed Minton. The girlfriend, who was not identified, said Greenway took Minton to Beaver Lake on June 1.

The woman recounted to a Rogers police detective what she said was Greenway's description of Minton's murder. Her description is included in the affidavit.

Greenway piloted a 2001 Sun Tracker boat to an island on the lake. He said Minton was talking about his then-girlfriend, which made him angry. He came up behind Minton, cut her throat, stuck her head in the water because she was still alive, then stabbed her in the forehead, according to the affidavit.

He then wrapped Minton in a shower curtain, used rope to tie weights to her, got back on the boat, drove away from the island and dumped her body in the lake, according to the affidavit. Greenway said he was drinking and taking pain pills at the time he killed Minton.

Greenway, who was identified as a suspect weeks after Minton's disappearance, is serving a 20-year prison sentence after pleading guilty in 2007 to drug charges.
