Man Shot Dies

Chavez Held In Connection With Murder

Posted: November 27, 2009 at 4:11 a.m.

— A man shot Wednesday in a Rogers apartment died Thursday morning at a Missouri hospital, officials say.

Another Rogers man, Aristeo Chavez Jr., 25, was being held Thursday at the Benton County Jail in connection with capital murder. No bond had been set as of Thursday evening.

A probable cause affidavit states that a third, unidentified man was involved in the incident. Police are continuing their investigation, said Cpl. Angel Murphy-Pearce, a police spokeswoman.

Chavez was also being held in connection with aggravated robbery and residential burglary, both felonies.

Police identified the dead man as Jorge Orta, 27, of Rogers.

Police planned to send Orta’s body to the Arkansas State Crime Laboratory for an autopsy, Murphy-Pearce said.

Orta was pronounced dead at the St. John’s Hospital in Springfield, Mo., at 8:18 a.m. Thursday, according to the affidavit.

The affidavit states Orta’s girlfriend was in the apartment at 2002 Commons Drive when Orta was shot in the head. She was later able to identify Chavez as one of the men involved in the incident, according to the affidavit.

Orta and his girlfriend, Michelle Garcia, were in bed when the door to their apartment was kicked open, according to police. Orta went to see what was happening, and Garcia saw two men in the living room and heard them arguing with Orta about money.

Police say Orta and one of the men started wrestling before Garcia saw the flash from a handgun. Garcia told police she heard about four shots.

The two men left the apartment.

Garcia called police at about 4:24 a.m. Wednesday. When police arrived, they found Orta on the living room floor, breathing but unresponsive, according to the affidavit.

Garcia later recognized Chavez as one of the men involved in the incident in a photograph and in person at the police department, according to police.

Benton County Jail records show that Chavez has a history of misdemeanor arrests.

The fatal shooting was the second in two months at the apartment complex.

Rogers Police Cpl. Jesse Ray shot and killed Matthew Dague on Oct. 1 following a chase and shoot-out, according to reports. Prosecuting Attorney Van Stone found the shooting was justified.

Inteseting comment, although you are probably not anonymous since every computer has a IP address. Again the Commons, maybe they need to screen the tenants better crazy or fire the managers who rent to these people.

Hindering maybe you don't live there. It is called Southwind Place. The manager is taking precautionary measures for the safety of the tenants. Cameras and extra lighting are being installed. As a tenant our complex is a nice place to live. Don't judge it by a few people making bad choices. There are many of us there that work, go to church and are raising our families the best that we can.

I dont live there but 2 people killed in 90 days? What does extra lighting and cameras have to do with the killings? It sounds like there is more crime there then we all know about to have this equipment installed. The police caught the man resposible for the killing, because of the girlfriend not the cameras and extra lighting.
