Teen Shooting Suspect To Remain In Detention

Posted: November 26, 2009 at 5:11 a.m.

— A 15-year-old boy will remain in the Benton County Juvenile Detention Center after his arrest in connection with a Sunday shooting of another juvenile.

The boy is charged in a juvenile delinquency petition with battery in the second degree and handgun possession by a minor. The boy pleaded not guilty to the charges during his initial court appearance Nov. 19.

His arrest stems from an incident where a 17-year-old was shot in the upper chest. Bethel Heights police made the arrest after responding to a call.

Debbie Pursley, the intake officer for the Benton County Juvenile Probation Office, testified during the hearing that several juveniles were at the scene at 1146 Remington Drive when police arrived. Police found a .357 caliber gun in a mattress and a shotgun in the attic, Pursley said.

Pursley said the handgun had been reported stolen, according to a police report. The police report also references a gang called the Three Corner Hustlers.

Pursley testified the shooting victim has a warrant for his arrest in a felony case. Police planned to interview him at Northwest Medical Center-Springdale, according to Pursley.

When questioned by Public Defender Lora Noschese, who represented the boy, Pursley said the boy claimed the shooting was accidental.

Noschese asked the boy be released since there was no evidence of him being a flight risk or him having problems with the court system.

Judge Jay Finch ordered the boy continued to be held at the detention center until several conditions are met. Finch wants an exact address of where the boy will be living. Finch also wants the boy to wear a home monitoring unit and wants to know more about the boy’s education history.

If released, Finch ordered the boy not to have any contact with the victim or any of the other juveniles who were at the Remington Drive address at the time of the shooting.
