Council To Consider Cell Restrictions

ORDINANCE COULD NIX TELEPHONE USAGE IN DESIGNATED SCHOOL ZONES

— Restricting cell phone use in school zones, considering the master trail route and approving the construction of a sidewalk are scheduled for discussion Tuesday when the Rogers City Council meets.

An ordinance restricting cell phones and other communication devices in designated school zones is back on the agenda after being tabled Nov. 10.

Council members were concerned the wording of the ordinance was ambiguous and open to interpretation.

The original ordinance made it a misdemeanor for drivers to use cell phones or other communication devices in school zones when school zone warning lights are flashing and school zone speed limits are applicable.

Some council members wondered if a driver could be cited when they are parked in a school zone waiting to pickup or deliver a student.

City Attorney Ben Lipscomb changed the ordinance to add it would not apply to parked vehicles.

The ordinance is to serve as an additional safety measure in school zones.

Should the council approve the rewritten ordinance, those violating the ordinance could be fined up to $100 and/or mandated to perform community service not to exceed 30 days.

Council members are expected to approve a resolution authorizing a contract with Tomlinson Asphalt Inc. to build approximately a half-mile of sidewalk on the east side of Arkansas Street from Maple Grove to near Poplar Street.

Tomlinson was the low bidder on the project at $85,795.

The master trail route ordinance, tabled at the Nov. 10 council meeting, may be tabled again, according to city officials. Some of the details still have not be worked out yet, City Clerk Peggy David said Friday.
