A Rogers woman won’t be tried for killing her husband until at least May.

Myrtle Walter, 76, is charged with capital murder. If convicted, she will be sentenced to life in prison.

Walker was arrested Oct. 4, 2008. She told police she shot and killed her 74-year-old husband, Paul, while he slept in the bedroom of their residence at 1105 S. 12th St., according to court documents. Police found a .357-caliber revolver at the scene.

Paul Walter was shot three times. One bullet grazed his face, while the other two were in his shoulder and neck.

Her jury trial was scheduled to begin Dec. 15. On Monday, Terry Harper, one of Walter’s attorneys, requested a continuance in the case.

Benton County Prosecutor Van Stone didn’t object to the request since Joel Bullard’s jury trial is set for the same date. Bullard is accused of killing his brother.

Circuit Judge David Clinger granted Harper’s request and vacated Walter’s trial in December. Clinger rescheduled the trial for May 25, 2010. A pre-trial hearing is set for 8:30 a.m. May 24.

During a police interview, Myrtle Walter said she could no longer take being mentally abused by her husband, an a

She previously pleaded not guilty to the charge and is free on $250,000 bond.
