Defense Wants Capital Murder Trial Reset

FAYETTEVILLE Attorneys for Ricky Ray Anderson, charged with capital murder in the death of Jill Lynn Ulmer, are asking for another delay because they’re waiting on a mental examination.
Anderson wants to pursue a mental disease or defect defense.
The case has already been reset once because the sides were not ready.
In a motion fi led Thursdayafternoon, Anderson’s attorneys say they’ve been told he could be examined at the Arkansas State Hospital by Dec. 3, but there’s no guarantee that will happen. The defense will also need time to analyze the report and, possibly, find experts to work on their behalf.
The case is currently setfor Feb. 1 in Washington County Circuit Court.
Circuit Judge William Storey reset the case in September because DNA and lab work had not been completed by the Arkansas State Crime Lab.
Ulmer, 26, was found with multiple stab wounds in her Fayetteville apartment on June 26, minutes after she called 911. Police said Anderson, 41, was still inside the apartment stabbing Ulmer when they arrived. Policeshot through a window at Anderson and missed. One bullet hit Ulmer in the head.
State medical examiners have said both the gunshot and stab wounds contributed to Ulmer’s death and either would have been fatal. She was stabbed 25 to 30 times and a major artery was severed.
Capital murder is punishable by life without the possibility of parole or the death penalty. Prosecutors are seeking the death penalty.
