Attempted Murder Trial Reset For Late January

— An attempted murder trial resulting from a shooting incident over the summer has been reset.

Luther Stueart, 22, is charged with attempted first-degree murder after an incident in which shots were fired at Kelvin Harris after an confrontation at a Dickson Street bar in July.

Stueart was to be tried Monday in Washington County Circuit Court, but both sides were still trying to locate and talk to witnesses last week. Reports on evidence were also still out.

Circuit Judge William Storey reset the case for Jan. 26.

Police say Stueart fired shots at a car driven by Harris just before 2 a.m. July 11.

No one was injured. Harris was on the phone with a 911 operator when the shooting happened on Double Springs Road.

Harris was at a downtown Fayetteville club earlier in the evening when he spoke with Whitney Ray, a female friend, police said. A man saw them speaking and told Ray he would kill her and Harris, Harris said. Harris and Ray left separately.

Harris noticed a purple Chevrolet Caprice following him and called police just before the shooting started.

Police found four bullet casings from a .40-caliber gun at the scene. One bullet struck Harris’ car.

A second man, Ray Smith, 23, of Prescott faces charges in connection with felony accomplice to attempted murder. His trial has also been reset for Jan. 26.
