Non-religious display OK'd for state capitol

Posted: December 14, 2009 at 2:11 p.m.

— A federal judge says a nonreligious winter solstice display can be placed at the Arkansas Capitol, siding with a group that sued after the secretary of state’s office rejected its proposal to counter a traditional nativity scene.

U.S. District Judge Susan Webber Wright ruled in favor of the Arkansas Society of Freethinkers, which accused Secretary of State Charlie Daniels of violating the group’s constitutional rights by not allowing its display.

The group sued last week and asked for a quick hearing before the winter solstice, which is Dec. 21. Group president Tod Billings says he hopes the display will go up Wednesday.

A spokeswoman for the secretary of state didn’t immediately return a call for comment Monday.
