Testimony of now-dead man allowed in murder trial

BENTONVILLE Benton County prosecutors will be allowed to use the past testimony of a now-dead man in the retrial of a man on a capital murder charge.
Roger Dale Barrett is charged in the August 2000 death of 40-year-old Eunice "Yogi" Bradley of Healing Springs. Barrett was convicted and sentenced to life in prison in 2001.
The conviction was overturned on the grounds Barrett's attorney was ineffective.
In his first trial Marvin Wise testified that Barrett confessed to him he accidentally shot Bradley. Wise has since died but Circuit Judge David Clinger ruled that prosecutors will be allowed to present his earlier testimony.
Barrett did not testify during the first trial but said during a hearing for his new trial that he accidentally shot Bradley.
Her burned body was found near Highfill by firefighters.
