Frizzell in Tulsa ruled against the 11 poultry companies that were sued by then-Oklahoma Attorney General Drew Edmondson in 2005. Frizzell didn&rsquo;t rule in the case until Jan. 18 of this year. His ruling found poultry litter from the farms supplying birds to those companies pollutes the Illinois River. Then on June 12, Frizzell ordered the parties to negotiate on a settlement on damages.</p>

6 Person Rule Opinion

This is a voting rights lawsuit filed by Plaintiffs Arkansas United and L. Mireya Reith against Arkansas Secretary of State John Thurston and the Arkansas State Board of Election Commissioners (“the State Defendants”) and the Benton, Sebastian, and Washington County Election Commission members, along with Sebastian County’s Election Coordinator (“the County Defendants”). Defendants are all sued in their official capacities. Plaintiffs allege an Arkansas statute that forbids individuals from assisting more than six voters in casting their ballot violates Section 208 of the Voting Rights Act (VRA), a provision of federal law that allows voters who require assistance due to an inability to read or write to have the assistor of the voter’s choice.

FAYETTEVILLE — The city is ready to dole out most of its American Rescue Plan money now that the federal government has issued final rules. The city was granted $17.9 million in the federal aid money and has received half the amount. The rest will come sometime this year.

The regulatory requirements placed by the City of Fayetteville on ADUs have resulted in a continuation of permitted or constructed units lower than staff anticipated and well below the potential to meaningfully impact housing options. Staff has seen the lack of affordable and flexible housing play out in real time while working through the short-term rental ordinance coupled with the supply-chain and affordability issues highlighted during the COVID-19 pandemic. Many property owners are looking for sources of income to pay mortgages and rising property taxes, and ADUs can serve this purpose while also contributing to the citywide variety of housing options in otherwise low-density areas. With well over half of Fayetteville zoned exclusively for single-family homes, ADUs can promote incremental increases in housing and density and complement existing housing stock in term of scale and impact. ADUs can afford existing property owners the opportunity to stay in their homes and not disrupt the fabric of the overall community.

Trammell Order

John Ward was acquitted of a terroristic threatening charge in August because of his mental condition. Benton County Circuit Judge Robin Green ordered Ward to turn himself in at the Benton County Jail, where he would wait until a bed was available at the State Hospital. Jon Comstock, Ward’s attorney, filed an appeal with the Supreme Court. Priority schools: 2012-14

The Arkansas Department of Education has identified 46 Arkansas schools as "priority schools," meaning they were the lowest achieving 5 percent of schools in the state over a three-year period, 2012-14, on state Benchmark and End-of-Course math and literacy tests. To be removed from the list, the schools must meet annual achievement goals and graduation goals for two consecutive years on new exams that are replacing the discontinued state tests.

Focus schools: 2012-14

The Arkansas Department of Education has identified 105 Arkansas schools as "focus schools," which are the 10 percent of the state's public schools that have the largest achievement gaps between student groups on state Benchmark and End-of-Course exams over three years: 2012, 2013 and 2014. The gap that is measured is the one between the "Targeted Achievement Gap Group," or TAGG group, and the students who are not in that group, the non-TAGG students. The TAGG group is made up of students who are from low-income families, have disabilities or are learning English as a second language. To be removed from the list, schools must meet annual achievement and graduation goals for two consecutive years on new exams that are replacing the Benchmark and End of Course exams.
